Man sentenced to 15 years in prison for DWI crash that killed boy in St. Charles County

ST. CHARLES COUNTY — A man was sentenced to 15 years in prison on Tuesday in connection to a 2023 crash that killed a 7-year-old boy in St. Charles County.

Dioavian Cook, 25, of Florissant, was given the maximum sentence after he entered a no-contest plea to one count of DWI resulting in the death and two counts of DWI resulting in injury.

The charges stem from an early morning crash in August 2023 when Cook was driving at high speeds in the wrong direction on Interstate 70 near Wentzville.

Cook's SUV struck the SUV of a Kansas City-area family that was returning to the state after a vacation in South Carolina, according to prior reporting. 

Zachary Allan, 7, was later pronounced dead at an area hospital. His parents, who were both injured in the crash, have filed a wrongful death lawsuit and have sued the Ballpark Village bar where Cook was drinking prior to the crash, alleging that the bar overserved him and then allowed him to get behind the wheel.

Two hours after the crash, a medical blood draw revealed Cook's blood alcohol content was .20% — more than twice the legal limit, according to charging documents.
